Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Fair Flow platform, mobile applications, and related services (collectively, the "Service"), provided by Fair Flow LLC ("Fair Flow," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Fair Flow provides salon and spa management software that allows businesses ("Salons") to manage their staff, schedules, communication, and daily operations, and, where applicable, to communicate with their clients.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date. You must be at least 18 years old to create an account.

3. Subscriptions and Billing

Access to the Service may require a paid subscription. New accounts may include a free trial period, after which a valid payment method is charged according to the selected plan. Subscriptions renew automatically unless cancelled. You may manage or cancel your subscription through your account settings. Fees are processed through our payment provider.

4. Messaging Program (SMS and Voice)

Program description: The Fair Flow messaging program sends operational voice calls and text (SMS) messages. Staff members receive operational notifications related to their work (for example, an alert that a client is waiting). Where applicable, clients receive appointment-related and service-related communications from a participating Salon.

Consent: Users opt in by providing their phone number and agreeing to receive communications from Fair Flow or the participating Salon.

Message frequency varies depending on your activity and role within the Service.

Message and data rates may apply. These charges come from your mobile carrier and are your responsibility.

HELP: Reply HELP for assistance, or contact us at support@fairflowapp.com.

STOP: Reply STOP at any time to unsubscribe from text messages. After you send STOP, we will send one confirmation message and then stop sending messages. Opting out of operational messages may affect the functionality of the Service for staff users.

Carriers: Mobile carriers are not liable for delayed or undelivered messages.

5. Acceptable Use

You agree not to misuse the Service, including by using it for any unlawful purpose, attempting to gain unauthorized access, interfering with its operation, or using it to send unsolicited or unlawful communications.

6. Your Content and Data

You retain ownership of the information you enter into the Service. You grant Fair Flow the right to use that information solely to provide and operate the Service. You are responsible for ensuring you have the necessary rights and consents for any client information you provide, including consent to contact clients where applicable.

7. Intellectual Property

The Service, including its software, design, and content (excluding your data), is owned by Fair Flow and protected by applicable laws. These Terms do not grant you any ownership rights in the Service.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

9. Limitation of Liability

To the fullest extent permitted by law, Fair Flow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

10. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and cancel your account at any time.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles.
